What do I need to prove in a premises liability case in New York?

To prove your claim, you first need to show that the defendant (usually the premises owner or manager) owed you a duty of due care to keep the premises reasonably safe and free from traps. “Traps” refer to things like wet floors, broken staircase railings and anything else that can cause someone to fall and hurt themselves.

Next, you must show that the defendant knew (or reasonably should have known) about a trap but failed to repair it or post a warning. And you must prove that, as a result of the defendant’s negligence, you fell and suffered an injury.

How long do I have to file a premises liability lawsuit in New York?

New York imposes a statute of limitations on premises liability claims. A statute of limitations is essentially a time limit on how long you have to file a lawsuit. For slip-and-fall cases, you generally have three years from the date of the accident to file suit. However, there are exceptions that can “toll,” or pause the time limit, depending on the facts of your case.

Can I still receive compensation if I was partially at fault for the accident?

Yes. Like many states, New York uses the comparative fault rule in personal injury litigation. This rule means that the plaintiff’s award is reduced by the percentage of fault the jury determines the plaintiff contributed to their own injuries. For example, if the jury finds that you sustained $100,000 worth of damages and were 10 percent at fault, you would receive $90,000. Even if you were mostly at fault, you might still be able to receive substantial compensation.
